Terms and conditions

When you join any of our events/activities organized by BAIS (Budapest Association for International Sports [legal name: Budapesti Egyesült a Nemzetközi Sportért], Address: 1094 Budapest, Ferenc tér 2-3. VII/2., Tax number: 18946426-1-43) and the Budapest Hikers teams (referred to as “The Organizers” or “Organizer” from here on, while “you” shall be also referred to as “Participant”) you must understand and accept the following Terms and Conditions:

General

By joining a BAIS and Budapest Hikers event, you acknowledge that you are responsible for your own actions and safety during the event. You declare that the Organizers (including its activity leaders, legal representatives, volunteers, members, and any other person associated with BAIS and Budapest Hikers) cannot be held liable for any loss, damages, or expenses (whatsoever and irrespective of whether direct, indirect, or consequential) caused by participation in the activity not directly caused by the organiser. These claims can be based on but not limited to: personal injury or death; property loss or damage; acts which may be construed as negligible or accidental; any other loss, damage, emotional stress suffered by you or any other person in relation to this activity booked via the event’s website.

Participants are responsible for any damage or loss they inflicted on equipment belonging to BAIS related to the organized activity such as frisbees, hiking equipment, bicycles, etc.

The organizers cannot be held responsible for any further disturbances or injuries (noise, bites, stings, rash, allergies, etc.) caused by animals.

Participants must implicitly follow BAIS staff instructions. All participants are obliged to inform the tour guides about their illnesses which may affect their participation in the hike or any medicines which may cause allergies. If a customer fails to disclose physical and/or other health issues, disabilities, or other factors that may make him or her unfit for the organized activity, acts irresponsibly and/or causes disturbances that result in endangerment of the provision of service and/or the health of other participants or the company, its reputation and its employees, that participant — after being warned by BAIS Staff — can be excluded from the participation in any or all activities run by BAIS. In such cases, BAIS may terminate the contract without any further notice, even before starting the organized trip with no refunds made. Any costs occurred by the actions of the participant are to be paid by the participant. Any shared information will be handled according to the current GDPR regulations.

By joining an event you are accepting responsibility for wearing appropriate clothing/footwear and equipment that may include clothing/footwear for inclement weather and ground conditions. You declare that you have been advised to obtain adequate travel and health insurance for all persons named on the booking.

Participants acknowledge that the tours organized by the Organizer, due to their nature pose an increased danger to one’s life and health, and in extreme cases may cause death. The Organizer shall not be liable for the event of death or any serious damage to health, nor any liability for damages that shall arise.

The participant is obliged to take care of the storage of their own luggage and hand luggage during the trip unless it has been taken over by the responsible representative of the supplier or service provider for the purpose of onward transportation or storage.

In the event of failure to withhold any insurance, Participant will bear the costs, expenses, and damages (including, but not limited to, hospital care, medical rehabilitation, dental surgery, medicine, medical aids and the cost of transporting patients, compensation for damage, non-pecuniary damage, and reimbursement of travel expenses) any of which could have been reimbursed if an insurance contract had been concluded prior, based on the general insurance practices. By accepting these Terms and Conditions, Participant acknowledges the responsibility to withhold insurance in a satisfactory category. The Organizer shall not be responsible for the damages not reimbursed by the insurer.

It is your sole responsibility to appear at the specified departure time and place of departure, otherwise, the program will be delayed, meaning you will not be able to use the service and you will lose the participation fee. It is your responsibility to appear at the program start time on time for each program specified in the travel guide. You acknowledge that in the event of a delay, the Program will start or continue as scheduled. The Organizer cannot be held responsible for the consequences and damages caused by the delay.

The Organizer expressly reserves the right to change the previously announced route or program without prior notice if the interests of the Participants and the program so require. The Organizer calculates the difficulty level and travel time of the programs on the trips for average conditions as well as average weather conditions. Deviations from this – shorter or longer travel times than advertised – are possible. In the event of deviations from the originally announced trip and the expected circumstances, the Tour Operator will not accept any complaints, withdrawals, or claims for damages other than those specified in these Terms and Conditions.

The contract is validly concluded when the organizer confirms the application. The acceptance/confirmation of the Organizer will be sent by e-mail to the e-mail address provided by the Participant.  If the content of the confirmation differs from the content of the order and you do not object to the difference within three days, or, if you make a payment after receiving the confirmation, the contract is valid according to the content of the confirmation.

You undertake to check the e-mail account previously provided regularly and to notify the Organizer immediately if the e-mail address changes.

If you make an order in favor of a third party, you have to make sure all notifications are communicated to the third party. Any rights and/or obligations of the customer under the contract shall be borne by you until the start of the ordered service except obligations which are, by their nature, are solely attributable to the third party person.

If the organized trip was not booked by you, but rather by a third party on your behalf, the Organizer is not obliged to check whether this third party legally represents you and whether the information provided by him or she is true. All rights and obligations belong to the Passenger from the beginning of the service. By taking part in the service provided, you acknowledge that these Terms and Conditions are binding for you.

You bear all responsibility for the truthfulness and accuracy of the data you have provided.

The participation fee – unless otherwise stated – contains no further fee or cost to be paid.

You cannot file a claim for not starting the tour either or if it shall be interrupted if any of the participants is endangered or has been or may be endangered or if one or more participants are in a situation endangering their own safety, life, or the health of the group.

The Organizer is entitled to increase the event fee due to the increase in the cost of transport (in particular fuel prices, entry ticket prices), taxes, and other mandatory charges (eg. fees and other charges, tolls, etc.), as well as due to changes in the forint exchange rate. The amended fee increase is calculated according to the number of passengers. The Organizer shall in all cases issue a written notice of the amount and reason for the fee increase. The participation fee payable under the contract cannot be increased within seven days before the start of the trip. If the rate of increase exceeds eight percent, you have the right to cancel your participation at any time. In the event when the fee increase is more than eight percent, the parties may amend the contract between them.

All participants participate in the tour at their own risk.

General risk reduction is the Participant’s interest, responsibility, and obligation, in particular the prohibition of alcohol consumption before and during the tour, the use of detours or alternative routes are chosen without consultation with the guide, not using hiking boots in the case of hiking, not using helmets and life jackets or neoprene clothing while rafting. Individual route selection or return is not allowed. If someone does not want to continue the tour and the tour is led by several tour guides, the tour guides based on the decision of the hiker can allow one’s return but even if he/she can return, the penalty amount shall be the same as the tour fee, but shall be at least 10.000 (ten thousand) HUF paid on-site in cash.

The Contracting Parties are obliged to co-operate with each other in good faith and to inform each other carefully about all material issues and circumstances related to this contract. Legal notices or complaints concerning the performance of this contract shall be recorded in writing by the agreed or communicating party and forwarded immediately to the other contracting party or its representative in person or by registered mail or fax to the other Contracting Party’s registered office or address, or to the Tour Operator or Participant via email.

All on-site, accommodation, carrier, and program descriptions, brochures, leaflets, electronic brochures not issued by the Tour Operator, including the performance of the travel contract the Organizer shall not be held liable, and shall not be obliged to perform them in whole or in part.

All participants must be at least 18 (eighteen) years old to make a reservation.

A person under the age of 14 may only take part in the event under the authority of his/her legal representative(s) or in the possession of a separate Statement of Full Responsibility (eg. with 2 witnesses) made by his/her legal representative, which in it original nature shall be handed over to the Organizers or its Tour Agent before the start of the event. Failure to provide the original statement will result in the person under the age of 14 not being able to attend the event and will be disqualified with the loss of the participation fee. The Organizer shall not be liable in any way for any injury, pecuniary or non-pecuniary damage resulting from the slightest failure to comply with these instructions. Specific Terms and Conditions

All participants must bring their valid passports or ID cards for the trip/hike.

All participants must have valid health and accident insurance at least for the duration of the trip (from departure to arrival), covering the destination country of the tour and the extreme activities performed as part of the service.

It is one’s sole responsibility to appear at the specified departure time and place of the departure, otherwise, the Participant will not be able to use the service and will lose the participation fee. The participant accepts that in the event of his/her delay, the Program will start as scheduled or continue as scheduled. The Organizer cannot be held responsible for the consequences and damages caused by the delay of any Participant.

Participant declares that he/she is taking part in the trip at their own risk and accepts that the Organizer cannot protect anyone from the consequences and dangers arising during the trip. The Organizer cannot be held liable for any damage, damage to health, or death caused by the Participants negligence, inadequate care of the situation.

You are required to work with the group attendant and other passengers during the trip. There may be situations where the group attendant has to give instructions to the passenger(s) that the passengers are obliged to follow in order to successfully complete the journey and to avoid bodily injury. If one of the passengers does not follow the instructions of the group attendant and thus endangers the physical integrity of himself or others, the Tour Operator is entitled to terminate the travel contract with immediate effect and enforce a claim for compensation against the Passenger.

In most cases, one of our tour guides will go at the beginning of the group and the other at the end. If there is only one tour guide with the group, he or she will guide the beginning of the group while keeping an eye on the end of the group. On some roads, our local partners also actively assist with tour guidance.

For safety reasons, never overtake the front guide on the tours and do not miss the rear guide. You don’t have to worry about the pace, we’re waiting for everyone. Unfortunately, there is no way to achieve individual goals on group tours.

By accepting these Terms and Conditions, Participant acknowledges that the participation fee does not include the health, cancellation, and/or insurance fee, nor any of the surcharges that may occur.

During the hikes, the tour guides (activity leaders) must be followed to avoid the risk of accidents.

The participation of a person under the influence of heavy alcohol or drugs in our events is strictly forbidden!

Participants must also show tolerance for their fellow passengers, and try to withhold any activity that might spoil, make it difficult or impossible for any other member of the group to travel or relax.

The participant has the right and obligation to warn the violator of the hiking order, to report the detected irregularities, as well as the damage and pollution to the Board of Budapest Association for International Sports.

Everyone participates in the organized activity voluntarily and at his/her own risk.

It is the Participant’s sole responsibility to appear at the specified departure time and place of the departure, otherwise, the program will be delayed, and the Participant will not be able to use the service and will also lose the participation fee. The participant accepts that the Program starts according to the program plan or continues according to the program plan. For the consequences and damages caused by the delay, the Organizers cannot be held liable.

By accepting this contract, you acknowledge these possible circumstances and declare that you are taking part in the trip willingly at your own risk, and accept that the consequences of situations and dangers during the trips can’t be prevented by the Organizers. Your inattention and/or inadequate care for the situation causing damage to health, death despite the warning or Instructions or the Organizers, shall be addressed as your liability.

It is seldom, but sometimes tours can be affected by the weather. Other times, roadblocks, traffic difficulties, or other unforeseen force majeure events prevent us from fully implementing the program originally planned. In such cases, in order to protect the safety and health of the participants, our Tour Guides may exercise the right to change the program. In extreme cases, they may even lead to terminating programs. In the event of shortening or termination of programs or tours, tour guides will try to offer the best alternatives to the best of their ability. In the event of a change, the Organizer holds no financial responsibility.

You declare that you will only take part in the trip organized by the Organizer and its programs if your state of health allows it. In addition, you declare that you do not suffer from an illness that puts you and your passengers at greater risk than usual while completing the program. You declare that you will follow the instructions of the group attendant during the trip.

Assets and equipment provided by the Organizer are to be used in accordance with its purpose, to preserve their integrity. For any damage or the loss of these tools and equipment, the Participant using them shall be held liable. The Organizer is entitled to withdraw with immediate effect from the contract if the Participants own equipment does not comply with the requirements set out on the website or in the passenger information, or if, in the opinion of the group attendant, it may endanger the health of themself, the fellow passengers or the successful completion of the journey.

You declare that you accept the customs, foreign exchange legislation, health regulations, etc. related to the program and observes and respect the laws and traditions of the host country. For damages resulting from failure to comply with these obligations, you shall be held liable in an unrestricted manner noting that the Organizers shall not be liable for any of such damages.

You note that it is your own responsibility to find out about and comply with the entry conditions of the country of destination (in particular, but not exclusively: the existence of valid travel documents/visas/vaccinations, pre-registration for some countries).

You note that if the country of destination refuses your entry for any reason, the tour will continue without your participation, in which case the Organizers do not reimburse the participation fee, and are entitled to keep 100% of it.

In most cases, it is forbidden to choose a route other than that shown and/or said by the Tour Guide. A hiker who violates the route planned may be excluded from the tour. The route shown by the tour guide and the instructions of the tour guide must be followed exactly on snowy, icy, slippery, muddy or rolling, and rocky terrain, as well as during rafting.

It is forbidden to drink alcohol or use drugs 6 (six) hours before the tour and during the tour – or even if the drug is not on the officially banned list – consume mind-altering substances. A hiker in violation of the ban will be excluded from the tour. It is the DUTY of the tour guide to exclude a hiker with possible dilated pupils and behavior.

The participant is obliged to inform the tour guide about the possible medication, or the consumption of substances that affect the performance and concentration skills, or any illness or condition that even temporarily reduces the state of consciousness and physical abilities.

The participant has a particularly important obligation to inform the Organizers about the following: pacemaker, diabetes, epilepsy, hemorrhage, and insect bite allergy. In the latter cases, the tour guide will consult with the participant separately for the safety of the participant.

On mountain hikes (especially in a rescue situation), situations may arise (such as the prevention of a threat to human life or the prevention of damage to health or the elimination of any danger or problem) where the participants are given tasks by the guide. These tasks are mandatory.

The tour guide has the right and obligation to exclude a person from the tour, anyone endangers his or her own or others’ physical integrity and equipment, do not follow, ignores or violates any instructions of the tour guide, or behaves in a forbidden way. In addition, a hiker who either violates the well-being of others violates his or her right to cultured and healthy recreation, or whose condition or behavior is considered undesirable by the tour guide will be excluded from the tour. An excluded participant may not claim a refund of the participation fee.

If the tour fails for reasons attributable to the Organizers, the Organizer will reimburse the paid participation fee in full, but the tour operator will not be liable for any other compensation, including causal damages. If the tour fails for reasons not attributable to the Organizer, the tour fee will not be refunded, however, the unpaid tour fee and other fees will become due and the tour operator shall not be held liable for any causal damages.

A hike ends when the group arrives back to the set end destination specified in the given hike description. Any additional activities (for example, pub visits) after the event are not considered official part of the hiking event.

If the tour fails for reasons not attributable to the Organizer (due to the road, snowstorm, floods, etc.) but at the time of application, the hiker can pay 10,000 HUF /day for the same number of hiking days per person as an across-registration fee. The Organizers will offer an alternative tour or tours held/implemented at the same time or at a different time.

All participants are obliged to inform the tour guides about their illnesses which may affect their participation in the hike or any medicines which may cause allergies.

Only those who do not have any cardiovascular or musculos, infectious or physical or mental disability may take part in the trips, in particular the walking tours. Participation in tours, therefore, requires good health in general, and any illness or injury that would prevent the successful completion of the tour is an exclusionary reason.

In some countries, vaccination or medication is recommended or required. Detailed descriptions of the trips provide sufficient information on this topic, but it is advisable for all participants to consult their GP or the health specialists of the given county, the International Vaccination Center, or the International Vaccination Station.

Proper walking coordination, as well as step safety, are mandatory conditions for all walking tours. On more difficult hikes, the lack of agoraphobia is important. The travel program shall bear a warning about such circumstances.

The condition for participating in a cycling tour is that the participants have proper knowledge of the bicycle, are aware of the traffic rules for cyclists, and do not indicate danger to themselves, their peers, or third-party road users. The condition for participating in water tours is sufficient swimming knowledge.

Travel programs include a description of the physical difficulty of the tours. These are, of course, subjective value judgments, but information about the difficulty of the tours can be requested from the Organizers at any time before the trip and from the Tour Guide on site.

If the tour guides consider that the participant does not meet the above conditions, they have the right to exclude that person before starting the trip!

The Organizers hold the issue of environmental protection important; and will do their best to organize the trip in such a manner. They expect a similar attitude and environmental awareness from the participants as well. Littering, picking protected plants, disturbing, abusing animals, and other environmentally damaging activities during travel are prohibited. Smokers must be mindful of their fellow passengers, residents of the given country, and must comply with the smoking restrictions of certain countries and under no circumstance can litter.

The tours are considered eco-tours, where we try to enjoy nature in the least possible harmful way.  Everyone is obliged to leave no trash along the hiking trail and to place the trash and other waste in the dedicated rubbish bins. This is the basis of sustainable tourism, which we also expect all participants to comply with.

Traveling and hiking are physically and mentally tiring activities. During active programs, participants can get closer to their mental tolerance. However, we must not forget that wherever we go, we are guests where we have to behave culturally accordingly. As soon as we arrive at the destination of the trip, we immediately find ourselves in a different cultural circle, where, depending on the country, customs, worldviews, rhythms of life, values , and religion that might be radically different from ours. We must be tolerant of these. Many countries have less developed infrastructure than Hungary, where the standard of living is much lower. In some countries, there are strict rules of dress and behavior, which are also desirable for foreign travelers to follow. In quite a few countries, especially in Southern Europe, Latin America, and Africa there are people with a radically different mentality from us who should not be expected to have the same flexibility that we may be accustomed to at home.

An adventure tour is a form of travel in which travelers find themselves in radically different situations than usual, in lesser-known places or less civilized. In most cases, some form of physical activity, especially hiking, biking, or rowing, is an integral part of adventure tours. The location of active programs is in almost all cases distant from populated areas, where we cannot expect too many important achievements of civilization. Activities, as well as close-to-nature locations, pose a degree of risk to travelers. The Organizer, of course, tries to reduce the risks taken by the participants to ensure the safety of the Participants, but only to the extent that it does not significantly reduce the enjoyment of the adventures and which can be justified for safety reasons.

In addition to the active programs, the adventure tour often includes the type of accommodation or means of transport.

During adventure tours, there can sometimes be unexpected situations that require adequate tolerance from travelers. In such cases, a positive attitude and understanding of new situations are desirable. The tour guide will do his or her best to get the best possible results despite unexpected situations, but participants will also be expected to have some adaptability.

Cancellations & Refunds

We offer a refund of the purchased ticket if the event is cancelled by the organizers due to unforeseen circumstances such as extremely bad weather conditions or restrictions linked to global pandemics or any other vis major events. Please note that rainy or windy weather alone does not classify as bad weather, therefore if the tour guides (activity leaders) decide to lead the hike, no refunds will be made to those not present or canceling their participation due to the weather conditions. It is the hikers responsibility to dress and bring weather appropriate clothing. Guidance from the Organiser will be provided.

In the mountains / high mountains, the water level of streams and rivers, the snow situation, the wind, and in general the conditions of the weather can change quickly and significantly. The Organizers cannot be held responsible for weather, water level, terrain, or external risks on the route.

The Organizer is not responsible for any situation, damage, difficulty, or inconvenience caused by natural disasters, natural and external conditions, making the tour difficult or risky. The risk of natural and other external conditions shall be borne by the Participant.

Due to the objective external variables (such as the weather, high mountain conditions, etc.) the start and effectiveness of the tours cannot be guaranteed. The leader of the given event bears the right to decide on the program and/or route changes.

In any case, where the event does not start for any reason not attributable to the Organizers, the Organizers shall not be held liable to pay any compensation nor to be obliged to reimburse the fee.

We do not offer refunds if a Participant cancels their participation in an event and the hike is not cancelled by the organizers. In such cases, the ticket can be resold, but the ticket holder has to notify the BAIS and Budapest Hikers teams in advance.

If you do need to cancel your attendance or will be sending an alternate person in your place to an event for any reason (which is possible and for which there is no additional charge), then please contact us at info@wemovebudapest.com.

GDPR

BAIS complies with the (EU) REGULATION 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016. and the Articles of 2011. évi CXII. Regulations. By joining a BAIS and Budapest Hikers event, you acknowledge that BAIS stores and transfers your personal data to OTP Mobil Kft. (1093 Budapest, Közraktár u. 30-32.) as a data processor. The following data will be transferred: name, company name, e-mail address, phone number, address.

During the organized trip photos and videos will be taken that can be published on the website and social media channels of BAIS and Budapest Hikers. The participant should acknowledge that these photos could be used by BAIS and Budapest Hikers for the purposes of promotion.

COVID update

Considering the current situation caused by the COVID-19 pandemic, you declare that you will only participate in the event/activity if your state of health allows it.

You specifically declare that:

You are aware of and acknowledge the dangers of the COVID-19 crisis.

You do not suffer from any symptoms that are typically associated with SARS-CoV-2 infection (“COVID-19” disease/coronavirus) that is not due to a known cause and You have not had such a symptom in the last 14 (fourteen) days. (Typical symptoms associated with COVID-19 infection are: dry cough, fever, difficulty breathing, headache, sore throat, limb pain, loss of smell and/or taste, nausea or vomiting, runny nose, diarrhea, muscle, or other body aches.)

To the best of your knowledge, You are not infected with a coronavirus.

To the best of your knowledge, You have not had contact in the past 14 (fourteen) days with a person who has been infected with a coronavirus or with a person who is under surveillance for coronavirus.

You agree to always comply with the latest Governmental Regulations regarding the pandemic.

Changes to the Terms and Conditions

The organizer reserves the right to change these Terms and Conditions at any time without notifying customers. Any future bookings request you may make will be subject to the General Terms and Conditions which apply at the time and date on which a booking is made. You are advised to read all the Terms and Conditions carefully on each and every occasion prior to making a booking.

The parties agree that the present legal relationship is governed by Hungarian law.

You declare that you have read and acknowledged the Terms and Conditions of the trip organized by the Organizer. You accept it as binding on yourself and your fellow passengers.
